in this edition we've got an important update from Fish Legal about
its challenge to canoeing's national governing bodies. We are pleased
that this has generated mainstream news awareness with the story being
reported by The Times, ITV and the BBC
and we'll keep you posted on any further developments.
Chief Executive Mark Lloyd sets the record straight on our
canoes campaign
"There
are some people inside and outside the angling community who have accused
us of being kill-joys and taking a "get off my land" attitude.
The Angling Trust and Fish Legal are not trying to stop people
canoeing. There are thousands of miles of navigable canals, lakes
and rivers where there is a statutory right of navigation (e.g. Thames,
Lower Severn, Lower Wye, Lower Trent etc.) and we are not trying to limit
access to these waters.
In
fact, we think there are lots of opportunities for more canoeing to take
place on some of the other rivers where there is currently no such right
of access. However, our members can’t draw up agreements to open up
access on these rivers if the canoeing organisations won’t accept the law
because people will not respect the agreements. Fish Legal’s letter
before action aims to get the canoeing organisations to accept the law,
if necessary by order of the court, so that we can have a solid
foundation, agreed by all parties, which could provide the framework for
our members to draft agreements to open up more rivers for canoeing, at
times and river heights which will avoid impact on the environment and
fishing.
Our
members have tried repeatedly to reach such agreements with the canoeing
governing bodies in the past, but they have often refused to sign them
unless they allow 365 day a year access with no restrictions. In crowded
countries such as England and Wales, it isn’t possible to have a
free-for-all; it is perfectly reasonable to have rules to ensure that the
needs of all users are balanced to avoid conflict and damage to the
environment so that everyone can enjoy our wonderful rivers.
Anglers
have closed seasons and all sorts of restrictions on their
activities; we also pay a rod licence to the Environment Agency and
pay permits to fish. Angling clubs have invested hundreds of millions of
pounds in buying and leasing fishing rights, the value of which would be
under threat if unlawful and/or unregulated canoeing were allowed to spread.
It’s only fair that canoeists should respect the legitimate rights of
others and agree to restrictions which protect the environment and
fishing. Getting the canoeing governing bodies to stop suggesting
that the law might be unclear is the first step in the process of making
it possible for more people to go canoeing on more rivers, lawfully and
without causing conflict.

Anglers
Launch Legal Challenge Against Canoeing National Governing Bodies
Fish Legal
has sent a legal ‘letter before action’ to the British Canoe Union (BCU),
Canoe Wales (CW) and Canoe England (CE) demanding that they stop
publishing information suggesting or asserting that there is a general
right of navigation on non-tidal waterways in England and Wales, and/or
that the law relating to navigation on rivers is unclear. Fish Legal will
seek ‘declaratory relief’ through the courts unless BCU, CW and CE amend
their publications and stop publishing inaccurate information about the
law to their members and the public.

Sulphuric
Acid Pollution on River Devon
Scottish
Water has been fined £10,000 for a major pollution incident on the River
Devon that occurred in 2011. The firm pled guilty to allowing
concentrated Sulphuric Acid to escape from their facility on Castlehill
Reservoir, Clackmannan and into the River Devon. The escape led to a
considerable fish kill on the upper stretches of the Devon. Fish Legal is
advising the Devon Angling Association with respect to legal action
against Scottish Water for the substantial losses the Association has
suffered as a result of the incident.

lures. He reckons they are a great surface predator that hits hard and
are the nearest thing we’ve got to some of the warm water sportsfish

challenging due to the failure of governments to implement a proper bass management
plan that includes protection for juvenile fish and a sustainable minimum
landing size.

The Salmon
& Trout Association (S&TA), the Angling Trust and Fish Legal have
written to the Centre for Environment, Fisheries and Aquatic Science
(CEFAS) to express their concerns over a draft proposal to farm rainbow
trout off the shores of the South West of England.

Stocks Crash - Angling and Fisheries Organisations Call for Urgent
Government Action
Following
official figures showing the worst estimates of salmon stocks on record,
a coalition of concerned angling, fisheries and conservation groups has
written to Government Fisheries Minister George Eustice and to his
counterpart Edwina Hart in the Welsh Assembly Government, to demand
urgent implementation of a five point action plan to halt the sharp
decline in salmon stocks in England and Wales.

in aid of ABF The Soldiers Charity

Nations Competition Success for Angling Trust Team England Fly Fishing
The first ever
5 Nations Fly Fishing Competition proved a great success as part of the
Stirling International Angling Festival. The Competition attracted
multiple teams from France, Ireland, England, Scotland and one team with
competitors from both Belgium and Luxembourg. The event was fished at
four venues - the River Carron, the River Devon, Carron Valley Fishery
and the Lake of Menteith.

Barnsley
& District AA Crowned Angling Trust Division 1 National Champs
42 teams
(420 competitors) fished the River Trent on various sections of the river
from the non-tidal section downstream of Nottingham to the tidal section
upstream of Torksey in the Angling Trust Division 1 National Championship
on Saturday 9th August 2014.
