Government Fracking Controls Not Enough
Says Angling Trust

Angling and conservation groups have given a lukewarm welcome to this week’s Government announcement that National Parks and Areas of Natural Beauty will be afforded special protection and fracking developments will only be allowed within them under ‘exceptional circumstances’. Although a useful step in the right direction this definition remains unclear and will not prohibit all fracking in these areas.
"This is a missed opportunity to ensure that all designated sites, which are highly sensitive and of great value to wildlife and fisheries, are properly protected from the outset." - Angling Trust Campaigns Chief Martin Salter.

Reservoirs Act 1975
Who Bears the Cost of Upkeep?

Defra has finally responded to Fish Legal's continuing enquiry for clarification on whether those who merely hold fishing rights separate from the land could be responsible for (potentially expensive) reservoir safety under the Act. Defra's response was less than definitive. It sought to reassure that if clubs or fishery owners only hold the fishing/sporting rights, then they are unlikely to be caught as they do not own or lease the physical asset/reservoir, provided their use of the reservoir does not amount to using it "for the purposes of any undertaking". It is not clear in the Act what this means, and if a club or fishery owner qualify in this way then it is possible for them to stand in front of any actual owner of the reservoir and be primarily liable for safety measures. According to Defra, relevant considerations would be: 1. whether the level of usage is extensive; 2. Whether the level of control (of the reservoir and its physical features) justifies liability for the safety of the reservoir; 3. that the level of control would be the determining factor; and 4. that each case will depend on its own facts.
Unhelpfully, Defra does not anticipate issuing formal statutory guidance on this topic, or otherwise clarifying this issue in the Act. Fish Legal has a factsheet on Reservoirs that can be made available to Fish Legal members.
